What does your employment contract say? If you're in the US, you're probably employed "at will". Virtually any policy is legal under "at will", as long as it isn't discriminatory for/against a protected class. It's entirely legal to say that everyone below pay grade X can only accumulate 80 hours of vacation time and then goes on "use it or lose it", while if your title has a "C" at the front, you can do whatever you want. They can't, for instance, pick on pregnant women, but they can, as a general policy, prevent a pregnant woman from accumulating vacation time if they prevent everyone in her job category from doing so.

That doesn't mean a whole bunch though, because the HR lawyers will tell the company exactly what it wants to hear. If you're really curious, best way to find out is to file a law suit. Now there's someone who doesn't understand management speak. As in, "the performance of your group is immune to any cuts we might make..." means you're so overstaffed that they can cut your group in half and it would be immune. You want your group to be extremely sensitive to any cuts.
